Can I Get Social Security Disability Benefits for Burns?

The Social Security Disability Insurance program, or SSDI, helps millions of Americans get by when they are disabled and unable to work. Summit Disability Law Group is dedicated to helping deserving claimants get these benefits.

When we sit down with potential clients, they ask us many questions. One common question is “can I get Social Security disability benefits for burns?” If you have this question, you came to the right place. This page answers it and explains the basics of the claims process.

Severe burns can damage skin, muscle, and in some situations, bone. This damage can make work impossible during the recovery process. If you find yourself in this situation, you may be eligible for disability benefits. The disability lawyers at Summit Disability Law Group can help you with your case.

What Types of Burns Qualify for Disability Benefits?

In any disability case, your medical condition must meet the Social Security Administration’s requirements. The SSA outlines some of these requirements in their “listing of impairments.” This listing includes many disabilities and medical conditions that often qualify for Social Security disability benefits. One of these conditions is “soft tissue injury,” which includes burns.

If your burn meets the following requirements, you may qualify for benefits.

  • The burn affects an arm or leg, your torso, or your face and head

The SSA’s listing states that your burn must affect one of these areas. Specifically, it uses the terms “upper or lower extremity” to refer to your arms and legs. It uses the word “trunk” to refer to your torso. This includes the central area of your body, not including your limbs, neck, and head.

  • Your burn is “under continuing surgical management”

This means that your burn is still receiving surgery or other medical treatments. The goal of these treatments must be to fully restore the functioning of the burned areas.

There are many situations that can meet this requirement. You may need additional surgeries, or you may be experiencing complications from a previous surgery. Or, you may have an infection that needs treatment. These are just some forms of “surgical management.” An experienced lawyer can help you determine whether you meet this requirement.

  • The burned area does not fully recover, or is not expected to recover, within 12 months

As we mentioned above, your medical treatment must be aimed at restoring the burned area’s full functioning. If this full recovery does not occur within 12 months, you may be eligible for benefits. You may also be eligible if your recovery is not expected to occur within this time period.

How Can Social Security Disability Benefits Help Me?

Disability benefits can help relieve some of the financial stress of living with a disability. In the case of burns, a serious and unexpected accident can instantly hurt your ability to work and earn money. This loss of income can make the injury recovery process much more difficult. The SSDI program will not replace all of your lost wages, but it can be a significant help.

Social Security disability benefits include both cash and medical benefits.

  • Cash benefits

These come in the form of monthly checks. The amount of cash benefits you receive depends on the details of your situation. In general, the more money you earned and paid in Social Security taxes before you became disabled, the more you can receive in benefits.

  • Medical benefits

In some situations, receiving SSDI can qualify you for Medicare. This health coverage can help you receive essential medical treatment for your disability.

If you are disabled and unable to work, Social Security disability benefits may be able to help you. An experienced disability lawyer at Summit Disability Law Group can help you build your case and file a strong application for benefits.
