If you recently underwent a lung transplant, you may be eligible to receive Social Security disability benefits. The experienced lawyers at Summit Disability Law Group know how to help you win a claim for these benefits.
A lung transplant is a serious and life-changing procedure, and it can take a long time to fully recover. Long recovery times often lead to physical, emotional, and financial stress. When this stress comes, many people start to wonder if they can get Social Security disability benefits after a lung transplant. The answer is yes, and this page explains how you can.
Many different types of disease can lead to lung transplants, including cystic fibrosis. You can qualify for benefits after a transplant due to any cause. Summit Disability Law Group offers free case consultations, so that you can understand your chances if you apply. We also give each client our “No Fee Guarantee” – you will not pay us unless we win your disability claim.
How to Win a Claim for Disability Benefits after a Lung Transplant
In order to receive Social Security disability benefits, you must file an application. The official name for these benefits is Social Security Disability Insurance, or SSDI. The Social Security Administration runs the SSDI program, and they will review your application for benefits. In order to win your claim, your medical condition must meet the SSA’s severity requirements.
For your convenience, we outline the requirements for receiving disability benefits after a lung transplant on this page. In order to qualify for benefits, you must meet the following guidelines.
- You received a single or double lung transplant within the past 3 years
The SSA’s list of qualifying conditions specifically includes lung transplants. In the listing, the SSA states that people who receive lung transplants should be considered disabled “for 3 years from the date of the transplant.”
So, if you receive a lung transplant on July 15th, 2017, the SSA will consider you disabled for 3 years from that date.
- If 3 years have passed since your transplant, you can still qualify if you are experiencing serious residual effects
Even if you received a lung transplant over 3 years ago, you can still qualify for benefits. The SSA states that after 3 years, they will review your “residual impairments.” This can mean many things. The SSA will consider residual effects such as the following.
- How well your new lung(s) function
- Any rejection of the transplant by your body
- Complications from the procedure
- Negative reactions to medication or other treatment
If any of these residual effects prevent you from returning to work and earning money, you may still qualify for disability benefits.
An SSDI attorney at Summit Disability Law Group can help you build a claim that meets all of the SSA’s requirements.
How Can Social Security Disability Benefits Help Me?
The Social Security Disability Insurance program is intended to help disabled Americans who can no longer work and earn money. If you had Social Security taxes withheld from your paycheck in the past, you may qualify. You paid into the system, now it is time for the system to pay you back.
You may know that SSDI offers monthly cash benefits. These monthly checks are what most people think of when they think of disability benefits. However, they are not the only type of benefits offered by SSDI. If you qualify for cash benefits, you may also qualify for helpful medical coverage benefits.
- Monthly cash benefits
If you are over 30 and worked at least 5 of the past 10 years, you may qualify for cash benefits. The standard type of SSDI cash benefits is a monthly check. This check can help you cover essential expenses month-to-month.
You may also be able to receive past-due and retroactive cash benefits. Past-due benefits cover the months that pass while the SSA reviews your application. Retroactive benefits cover the months that you were disabled before you applied.
- Medicare benefits
Serious disabilities often require regular medical treatment. This treatment can be expensive. Fortunately, the SSDI program offers health coverage benefits. Once you receive 24 months of disability benefits (including past-due and retroactive benefits), you are enrolled in Medicare.
These medical coverage benefits can help you receive the treatment you need.
If you work with Summit Disability Law Group, we will make sure that you will receive all of the benefits that you qualify for.
