Can I Get Social Security Disability Benefits with Cystic Fibrosis?
If the genetic disorder cystic fibrosis prevents you from working and earning money, you may qualify for Social Security disability benefits. The experienced disability lawyers at Summit Disability Law Group know how to help you build a strong case and get what you need.
We speak to disabled Utahns frequently, and people often ask us if they can get Social Security disability benefits with cystic fibrosis. The answer is yes, as long as the condition meets the Social Security Administration’s requirements. This page explains these requirements and the basics of disability benefits.
Cystic fibrosis can serious affect your lungs and other internal organs. The disorder often causes infections and breathing problems. If you are living with cystic fibrosis and need benefits, Summit Disability Law Group can help you. Our firm is 100% dedicated to Social Security disability cases, and you will not pay us any fees unless we win your claim.
When Can I Get Social Security Disability Benefits with Cystic Fibrosis?
The official name for Social Security disability benefits is “Social Security Disability Insurance,” or SSDI. The government designed this program to help working Americans who become disabled and can no longer earn money. The SSA provides a list of many medical conditions that often qualify for these benefits. Cystic fibrosis is one of these conditions.
In order to qualify for disability benefits with cystic fibrosis (CF), you must provide appropriate medical evidence. Appropriate medical evidence includes at least one document from both set A and set B below. These documents must come in a report signed by your doctor.
A. A positive newborn screen for CF, or a history of a sibling with CF, or medical documents showing a specific symptom or sign directly related to CF.
B. A positive CF “sweat test,” or identification of two CF gene mutations that affect fluid transport in your organs, or tests showing abnormal salt transport in nose cells.
In addition to this report from your doctor, your condition must meet one of the following severity requirements.
- Your FEV1 measurement is low
Your FEV1 measures the amount of air you can forcefully exhale in one second after inhaling. If your measurement is low, you may meet this requirement.
- You have been hospitalized 3 times in 12 months
If complications from your cystic fibrosis require you to be hospitalized 3 times in 12 months, you may meet this requirement.
- You suffer a “spontaneous pneumothorax,” or collapsed lung
If you live with CF and suffer a collapsed lung that requires a chest tube, you may meet this requirement.
- You suffer respiratory failure and require mechanical ventilation
You may qualify if you suffer respiratory failure and require either invasive or non-invasive mechanical ventilation. The ventilation must last at least 48 hours, or 72 hours if after surgery.
- You suffer a pulmonary hemorrhage that requires vascular embolization
A pulmonary hemorrhage involves bleeding in the lungs, throat, and nose. Vascular embolization involves placing small plastic tubes into arteries and veins to stop bleeding.
- Your SpO2 measurement is low
SpO2 measures the amount of oxygen in your blood. You must receive a low measurement twice in 12 months to meet this requirement.
- You experience two serious complications within 12 months
This can include general worsening of symptoms, hemorrhage, extreme weight loss, or diabetes.
Can a Disability Lawyer Help Me Get Benefits?
As you can see, disability claims are very detailed. Many claimants who try to handle their case alone get frustrated and give up. This is a mistake! An experienced Social Security disability lawyer can help you build the strongest possible case.
At Summit Disability Law Group, we represent disability claimants for a living. Unlike many other law firms, we only work on disability cases. We understand the claims process, and can make it work for you.
We offer the following free legal resources to help you during the claims process.
- No legal fees unless we get you the benefits you deserve
This is our “No Fee Guarantee.” We understand that many claimants are nervous about the expense of hiring a lawyer. While some lawyers charge large hourly fees for their services, we do not. We work on a contingency fee basis. This means that you will only pay us legal fees if we win your claim and get you the SSDI benefits that you need and deserve.
- Free disability case consultations with no strings attached
Living with a disability is difficult, and you deserve to be able to discuss your case with a professional in a comfortable environment. For this reason, we offer free case consultations with no obligations or strings attached.
During this consultation, we will apply our knowledge of the disability claims process to your situation. Then, you can make an informed decision about what to do.
- The Utah Social Security Disability Handbook
This is your guide to the Social Security disability claims process. We wrote this book to help disabled Utahns who want to learn more about their rights on their own time. It breaks down SSDI and the application process into simple terms.
We offer this book absolutely free-of-charge to anyone who is interested. You can order your free copy today by clicking here.
